Gaza -Press House
On Sunday, 1 November, 2020, Press House – Palestine (BAS) organized a workshop on the topic of "Recording Phone Calls from a Legal Point" via "ZOOM" application, in presence of 21 journalists from Gaza Strip, as a part of Journalists Have a Power project funded by Government of Canada.
The facilitator of a workshop was Mr. Abdullah sharshra - consultant of the legal unit in Press House – who talked about the issue of journalists registering phone calls without the permission of other parties, or their knowledge, where the workshop addressed the Palestinian Penal Code No. 74 of 1936, and its amendments in 2009, concerning the crime of violating of private life.
Mr. sharshra pointed out that the Palestinian applicable law in the Gaza Strip prohibits recording or filming phone calls without permission of other parties, explaining that the Penal Code No. 3 of 2009 provided for the punishment of those who commit these behaviors one year's imprisonment, elimination of registrations and confiscation of the recording tool, "the law did not make an exception granting journalists this right”.
This workshop aims to raise the awareness of journalists and provide practical legal guidance, and a process that contributes to building their legal abilities, based on practical experiences in which journalists are exposed to legal problems as a result of not following the correct legal steps.
